IEBC Turns Back to Supreme Court Over Nullification of August 8 Presidential Election

The Independent Electoral and Boundaries Commission (IEBC) has asked the Supreme Court to speed up in the delivery of the full judgement in its decision to annul the results of the August 8 presidential election.

In a letter, IEBC Lawyer Paul Nyamondi stated that the full judgement would guide the electoral body in preparing for the election scheduled for October 17.

“The reasons for the court’s decision are instructive to our client in its preparation for the fresh election ordered by the court.

"Duly instructed by our client, we write to kindly request the Supreme Court of Kenya to give its reasons for its said decision in the shortest time possible as its reasons will inform the manner in which the fresh election directed by the court will be organised and conducted by our client,” the IEBC letter read in part.

After annulling the presidential election last week, the Supreme Court announced that the full judgment would be out within the 21 days stipulated in the law.

After announcing the election date, IEBC Chairman Wafula Chebukati noted that only President Uhuru Kenyatta and NASA leader Raila Odinga would be on the ballot paper.

Thirdway Alliance party leader Ekuru Aukot, however, filed a case in the Supreme Court seeking clarity on which candidates are to participate in the fresh presidential election.

Aukot requested to know whether other candidates, save for President Uhuru Kenyatta and National Super Alliance (NASA) leader Raila Odinga, should be barred from the race.

Meanwhile, Odinga has rejected the election date set by IEBC arguing that he was not consulted.

The Opposition leader argued that there were thorny issues that needed to be taken care of first before the elections are conducted.
