Malindi High Court Gives IEBC New Order on Ballot Boxes Used in August Election

The Malindi High Court has ordered the Independent Electoral and Boundaries Commission (IEBC) to seal all ballot boxes used in Lamu County on August 8.

This follows a case filed by former Lamu Governor Issa Timamy challenging the election of Fahim Twaha as Governor.

Mr Timamy who was vying on an Amani National Congress (ANC) ticket filed the case last month asking the court to recount votes cast and declare him the winner if the recounted results indicated so.

In his affidavit, Timamy claimed that about 300 registered voters did not cast their ballot as their names were missing from the Kenya Integrated Electoral Management Systems (KIEMS).

The former Governor also alleged that that Mapenya, Lake Kenyatta, Mpeketoni Youth Polytechnic, Sinambio, Lake Amu, Hongwe, Bahahari, Umoja and Muhamarini polling stations had pre-marked ballot papers.

He accused Lamu Deputy Governor Abdulhakim Aboud of influencing the election result in favour of Twaha since he was a former Lamu East Constituency Returning Officer.

Timamy further accused IEBC of flouting the election process by allowing some people to vote without verification on the KIEMS machines.

Elsewhere, National Assembly Majority Leader Aden Duale opposed an application filed by former National Assembly Deputy Speaker Farah Maalim to have ballot boxes used in the Garissa Township parliamentary election on August 8 opened.

Duale argued that Maalim's application was premature urging the court to throw it out on the basis that all election materials for the polls were in the safe custody of the IEBC.
