High Court Makes 3 Decisions in Case Against IEBC

The Eldoret High Court has made a ruling in an election petition filed against Trans Nzoia Senator Michael Mbito, IEBC and a Trans Nzoia returning officer.

First, Justice George Kimondo directed that the case is heard on December 13.

Justice Kimondo also stated that nine witnesses would be called in to testify in the case challenging Mbito's election.

He further mentioned that the election petition will be heard for seven consecutive days before he makes his ruling regarding the matter.

The petition was filed by former area Senator Henry ole Ndiema who argued that the August 8 poll was riddled with irregularities and illegalities that interfered with the will of voters.

Mr Ndiema accused the returning officer of failing to allow him to appoint his own agents adding that this was part of a scheme to deny him victory.

The former Senator further claimed that the irregularities significantly affected the results adding that the numbers were not verified.

In his affidavit, Ndiema asked the court to scrutinise election materials used on August 8.

"The senatorial elections were marred with irregularities in a way that I was denied my victory," Ndiema stated.

IEBC and Mbito filed responses arguing the poll was free and fair and that no irregularities affected the final outcome.
