Presidential Candidate Ordered to Pay Sh100 Million

United Democratic Party presidential candidate Cyrus Jirongo has been ordered to pay Sh100 Million to COTU Secretary General Francis Atwoli.

The order was issued by the High Court which was hearing the case filed by Atwoli.

In court papers presented by Jirongo, he admitted receiving Sh100 Million from the COTU boss which was payable in 50 days with an additional Sh10 Million interest.

Justice Francis Tuiyot ruled that the former presidential candidate had entered an agreement with Mr Atwoli who had been given a Sh100 million friendly loan.

The UDP party leader had also accepted that Mr Atwoli could enforce repayment against him personally with a Sh10 Million interest.

The former influential politician stated that according to the agreement, the loan would be recovered from money Jirongo was owed by Nairobi City County.

He asked the court to intervene and either request Atwoli to wait until he is paid or for the COTU boss to personally pursue the County.

However, Justice Tuiyot in his ruling dismissed the argument stating: “In the face of the unequivocal acceptance of August 10, 2016, by Mr Jirongo to be personally liable for the advanced sums, he cannot shift liability.”

Mr Atwoli was also seeking to be paid damages for breach of contract.

The judge, dismissed the application observing that there was no attempt to prove breach thus Atwoli should await the full verdict of the case.

Jirongo unsuccessfully vied in the August election and conceded defeat but could be on the ballot in the October 26 presidential election
