NASA Leader Raila Odinga Defies Court Order

National Super Alliance (NASA) leader Raila Odinga has defied a court order where he was directed to respond to a petition filed in the High Court to compel him to participate in the repeat presidential election.

Last week, Justice Chacha Mwita ordered the opposition leader and Wiper Leader Kalonzo Musyoka to respond to a case filed by Pokot South Member of Parliament David Pkosing.

Through his lawyer Kibe Muigai, Mr Pkosing had told the court that neither Odinga nor his lawyers had filed submissions despite having been served with the court papers.

However, on Monday, the NASA leaders had not filed their responses neither did they send a lawyer to represent them in court.

The case proceeded as Justice Mwita heard arguments without the participation of the opposition leaders.

During the hearing, Mr Muigai argued that the withdrawal threats by the opposition coalition would create a constitutional crisis in the country.

"The threats by NASA may actually materialize in a significant number of constituencies and counties, thereby putting Kenya’s constitutional order into jeopardy," he explained.

Additionally, IEBC presented that the six other candidates would participate in the polls in light of Mr Odinga withdrawing.

On his part, Attorney General, Githu Muigai stated that the opposition leader had no right to obstruct voters from participating in the fresh polls. 

The High Court Judge will deliver his decision on October 24.
