Government Explains Why IEBC Officials Have Not Been Taken to Court

The government has explained why the Independent Electoral and Boundaries Commission (IEBC) officials who bungled the August elections are yet to be charged.

According to Director of Public Prosecution (DPP) Keriako Tobiko, the team tasked with investigating the individuals accused of bungling the elections have not submitted their investigation files.

Mr Tobiko has indicated that the Ethics and Anti Corruption Commission (EACC) and the police have not yet submitted their investigation files.

This is despite the elapse of the 21-day ultimatum of the investigation of the officials who breached the electoral laws.

“I note that no investigation files have been submitted as earlier directed,” read the letter dated 19th October.

On their part, the agencies have indicated that the investigations are at an advanced stage.

"You indicate that investigations commenced and are now at an advanced stage. Nonetheless, what would be most useful is a detailed status report on the investigations,” read the letter dated October 19.

The letter was addressed to Director of Criminal Investigations Ndegwa Muhoro and EACC Chief Executive Officer (CEO) Halakhe Waqo.

The EACC and the police are yet to respond to the demands or to interrogate some of the suspects.

A month ago, the DPP ordered the probe of top IEBC officials for alleged irregularities and illegalities in the management of the August election.

Among those he wants to be investigated are CEO Ezra Chiloba, Betty Nyabuto, Immaculate Kassait, James Muhati, Praxedes Tororey, Moses Kipkogey, Abdi Guliye, Marjan Hussein Marjan, Paul Mugo and  Boniface Wamae.
