High Court Throws Out Petition Against NASA MP After New Discovery

The High Court has dismissed a petition filed by Ganze Jubilee candidate Peter Safari Shehe against the current Member of Parliament Teddy Mwambire.

Justice Weldon Korir dismissed the petition filed on behalf of the former legislator after discovering that it did not meet the threshold requirements for a petition.

Justice Korir further stated that Mr Shehe failed to present documents which indicated the results of his opponent adding that the petitioner failed to use the reports to present his case.

“The petition does not show the number of votes cast in favour of each of the candidates who participated in the questioned election. The total votes cast in the election are also missing,” states part of the ruling.

The Judge ruled that Mr Mwambire was elected according to the rule of law and ordered the petitioner to submit his files and pay Sh2.5 Million to cover the total cost of the lawsuit.

Justice Korir on Tuesday dismissed a petition challenging the election of Kilifi Governor Amason Kingi. In the ruling, he directed the petitioner, William Kahindi, to pay the Governor Sh600,000.

The election of 92 out of 290 Members of Parliament has been challenged at the High Court after the August 8 General Election. Kakamega County topped the list with 10 cases filed.

At the closure of the petition-filing window on September 8, a total of 277 cases had been lodged challenging outcomes of six elective posts.

This represents an 89-case rise from the 188 petitions filed after the 2013 General Election.

The Judiciary has previously stated that judges and magistrates are ready to hear and conclude the cases within six months.
