Lawyers for NASA MP Withdraw From Election Petition

Two lawyers who were representing Changamwe MP Omar Mwinyi in a petition filed challenging his election have withdrawn from the case.

The Mombasa High Court ordered Mr Mwinyi to represent himself in the petition after Mohammed Balala and Abed Omar Abed filed an application to withdraw.

Speaking to Kenyans.co.ke, Mr Abed stated they that they had reached the decision after the MP failed to pay the legal fees as required.

“We filed an application to withdraw from the case as we have not yet received payments,” Abed stated.

The case had been filed by Changamwe Parliamentary race loser Abdi Daib who vied on a Jubilee Party ticket.

Daib filed a petition seeking to nullify the election in Mwinyi, claiming that the Independent Electoral and Boundaries Commission (IEBC) and the Returning Officer (RO) for the poll lacked credibility.

He stated that the data and information recorded in form 35A at the polling station was not accurately entered into the KIEMS kits.

He further told the Court that IEBC had denied 300 voters, mostly Somalis, from voting on the pretext that they were not registered voters.

Daib claimed that the voters had earlier confirmed and verified their registration details during the verification exercise which was conducted between May and June.

Mwinyi, who ran on an Orange Democratic Movement (ODM) ticket garnered 31,584 votes against Daib’s 9,769.
