Chief Justice David Maraga Sets Date of Petition Ruling

Chief Justice David Maraga has announced that the Supreme Court will deliver the judgement on the presidential petition filed against President Uhuru Kenyatta’s re-election on Monday, November 20.

Maraga made the announcement after the court finalised hearing the two presidential election petitions filed by former Kilome MP Harun Mwau and activists Njonjo Mue and Khelef Khalifa.

Mwau’s petition which listed IEBC, Chairman Wafula Chebukati and President Kenyatta stated that IEBC’s failure to allow parties to conduct fresh primaries before the repeat polls denied those who wanted to contest the election an opportunity to do so.

The former MP also attached a ruling declaring United Democratic Party presidential candidate Cyrus Jirongo bankrupt hence arguing he was unqualified to run for the Presidency.

Mue and Khalifa’s petition stated that IEBC flouted constitutional provisions in the fresh poll by gazetting strangers on the ballot paper and including National Super Alliance (NASA) candidate Raila Odinga in the presidential race despite his withdrawal.

Last week, the Court rejected a paupers' application by George Bush and John Chengo on grounds that it did not meet the required threshold.

Earlier on, the Supreme Court declined to admit the report on scrutiny of Independent Electoral and Boundaries Commission (IEBC) result forms by the petitioners.

Maraga, however, directed the petitioners to make observations on the results forms as they responded to IEBC and President Kenyatta's arguments.

On Wednesday, the judges ordered the electoral body to provide the original Forms 34A, 34B, and 34C to the petitioners in the ongoing petition.

The CJ also ordered the electoral agency to issue a certified copy of the voter register for scrutiny at the petitioner’s cost.
