Supreme Court Announces Date of Delivering Full Presidential Petition Ruling

The Supreme Court of Kenya has announced the date it will give explanations why President Uhuru Kenyatta's win in the October election was upheld.

Speaking to Kenyans.co.ke, an official from the Supreme Court registry explained that the ruling will be delivered on Monday, December 11, 2017.

The Constitution provides that a detailed ruling should be provided 21 days after the reading of a summary verdict.

In the case of the petition challenging the re-election of President Kenyatta, the summary verdict was delivered on November 20, 2017, with the 21 days elapsing on Monday.

During the Monday session, the judges will give details as to why they unanimously upheld the contested presidential election.

Some of the issues that came up during the petition and which the Court is expected to address in its detailed ruling include; whether IEBC should have conducted fresh nominations before the repeat election and whether the electoral agency erred in the declaration of final Presidential results without conducting election in 25 constituencies.

The withdrawal of Opposition leader Raila Odinga from the repeat poll and its impact in the contest will also be addressed.

Last month, the court, in a unanimous decision, okayed President Kenyatta's re-election and dismissed two petitions challenging his win.

In the summarised ruling read by Chief Justice David Maraga, the judges stated: "The court has unanimously determined that the petitions are not merited and the final orders are that the petition by Harun Mwau versus the Independent Electoral and Boundaries Commission and two others as consolidated is hereby dismissed.

“The petition by Njonjo Mue and another versus the chairperson of the Independent Electoral and Boundaries Commission and three others as consolidated is also hereby dismissed. As a consequence, the presidential election of October 26 is hereby upheld as is the election of Uhuru Kenyatta,” the CJ directed.
