Why Babu Owino Can't Leave Parliament Today

Embakasi East legislator Babu Owino released a statement on Wednesday alleging that he can't leave Parliament Buildings for fear of being arrested.

During the press briefing with journalist, Babu maintained that police had been stationed outside parliament waiting for him even after he was granted anticipatory bail by a Court of Law.

Babu urged the government to refrain from arresting Opposition leaders until the court finds them guilty.

His allegations come barely 24 hours after a High Court judge granted the NASA leaders a Sh100,000 anticipatory bail.

On Tuesday, the High Court barred police from arresting 12 opposition officials over their role in the 'swearing-in' of Raila Odinga on January 30.

Justice Luka Kimaru also granted an anticipatory bail of Sh100,000 to each of them and directed them to report to the Director of Criminal Investigations on Thursday next week and record a statement if required.

He ruled: “An order is issued stopping the police or their agents from arresting the applicants pending determination of their suit. They are also granted an anticipatory bail to stop police from detaining them.”

Through lawyer Nelson Havi, the NASA leaders alleged they had reliable information that police wanted to arrest and detain them in connection with Raila’s 'swearing-in'.

They maintained that the step to seek anticipatory bail was to avoid being detained like Miguna Miguna and Ruaraka MP TJ Kajwang.

Havi remarked: “The powers to arrest given to police are being abused and misused to harass, intimidate, and oppress the applicants and to achieve ulterior motives. They are ready and willing to be investigated through a lawful process".
