Embu Governor Martin Wambora's Election Nullified

The High Court has nullified the election of Embu Governor Martin Wambora.

The court ruled that irregularities in the race undermined the electoral process.

The petition was filed by former Senator Lenny Kivuti and earlier in January, a scrutiny and recount of a section of votes used in the August 8 gubernatorial election had been ordered.

Justice William Musyoka stated that Kivuti demonstrated there were numerous errors in the tallying exercise.

He cited Gategi Primary School polling centre stream one in Mbeere South constituency where electoral officials conceded that Mr Wambora had erroneously been awarded 400 votes.

Mr Musyoka added that evidence showed errors in forms 37A suggesting that several candidates had lost votes while others had their tally increased.

The judge added that while the final tally announced by IEBC officials indicated Mr Wambora beat Mr Kivuti by 985 votes, some IEBC officials had conceded that the margin could have been 299 votes.

Elsewhere, IEBC chairman Wafula Chebukati on Thursday stated that the electoral body is ready to conduct fresh elections in areas where elective positions were nullified.

Speaking at Mombasa Law Courts after voting in the Law Society of Kenya (LSK) elections, Mr Chebukati divulged that they had anticipated by-elections.

“The commission is ready for by-elections since it is something we anticipated and budgeted for,” he remarked.
