CS Peter Munya Loses Appeal Case on Corruption to EACC

East Africa Community and Northern Corridor Cabinet Secretary (CS) Peter Munya has lost a four-year court battle after the Court of Appeal gave Ethics and Anti-Corruption Commission (EACC) consent to investigate him.

CS Munya will be investigated on alleged procurement malpractices that took place during his tenure as the Meru County boss.

Issuing the verdict, the three-judge bench quashed the appeal by Meru County Government seeking to bar the ethics agency from carrying out investigations.

The judges argued that the Meru County Government had no capacity to lodge a case for violation of rights with regard to itself.

In the appeal, Munya sought to overturn a 2014 ruling in favour of EACC claiming that the investigations were politically motivated.

According to the appeal, Meru County had accused EACC of violating their rights after the seizure of documents from the county's procurement department in the course of investigations.

The appellate judges' bench, however, upheld the earlier decision noting that the county could not claim the violation of rights as would be the case of an individual citizen.

CS Munya's case, hence, lacked merit which led to the subsequent dismissal by the court of appeal.

Munya survived an earlier attempt by EACC to have him barred from defending the Meru gubernatorial seat in April 2017 .

In February 2018, EACC petitioned Speaker Justin Muturi over the nomination of Peter Munya and Ukur Yattani as Cabinet Secretaries alleging that their integrity was questionable.
