Gideon Moi Moves to Court to Evict Former Nakuru Town Mayor Samuel Towet Kibowen

Baringo Senator Gideon Moi on Tuesday moved to court seeking to evict his father's close ally, Samuel Towet Kibowen, from a parcel of land.

Moi has accused the former Nakuru Town mayor of wrongly occupying the 0.4-hectare land located in Nakuru town's central business district.

The Senator filed the case before the Environment and Lands Court in Nakuru seeking orders to evict and restrain Mr Kibowen from trespassing on the suit property.

Through his lawyer, Kipkoech Ng'etich, Moi further seeks orders to compel Mr Kibowen to vacate and hand over the land to him.

Mr Ng'etich exclaimed: “Pending the hearing and determination of the suit, I pray that the court is pleased to issue an order of eviction against the defendant.”

The KANU party chairman asserted that he is the legal owner of the land which the former civic leader has been renting out for business purposes.

In his submissions, Moi noted that he intends to develop the land after he terminated the tenancy of the former mayor in March last year.

“I had given the defendant a two-month notice to terminate the tenancy, but he has refused to vacate the suit property,” reads part of Mr Moi’s court papers.

However, in his defense, Kibowen also seeks to have the case struck out on grounds that it amounts to an abuse of the court process since the matter is being handled by the Business Premises Rent Tribunal.

According to him, the tribunal court issued orders on March 12, restraining the senator from interfering with his business pending the hearing and determination of the matter.
