Senator Agnes Zani to Pay House-help Ksh200,000

Nominated Senator Agnes Zani has been ordered by the Employment and Labour Relations Court to pay Ksh201,000 to her former house-help.

This followed a court case in which Eddah Ingalia, 25, sued the legislator over wrongful dismissal.

Reports by The Standard indicated that Ingalia had worked for the MP for over one year before her employment contract was abruptly terminated.

Delivering the judgement, Lady Justice Maurine Onyango indicated that she was convinced that the claimant was wrongfully dismissed by the senator.

The termination was prompted by an incident where Ingalia allowed the Senator's son, who was 21, to leave the house contrary to the instructions from her boss.

She told the courts that the termination caught her by surprise and was shocked at losing her job back in December 2014.

The complainant further noted that she had children in school and unable to pay her rent, was evicted from her house by the landlord.

In her ruling, Justice Onyango noted that the claimant suffered following her termination without notice and Zani's failure to pay her terminal benefits as required by the law.

Ingalia had told the courts that she had not been given off days during her 26 months employment as the house-help/messenger.

This saw the court award her Ksh80,000 compensation for the breach of contract, Ksh20,000 in lieu of one month notice, Ksh7,000 being 19 days arrears salary, Ksh44,000 in lieu of untaken leave for 26 months and Ksh40,000 gratuity.
