Court Orders Release of Miguna Miguna

High Court of Nairobi has ordered the immediate release of Miguna Miguna following his detention at Jomo Kenyatta International Airport. 

The judge, Justice Joselyne Aburili, further directed that he should appear before the court on Wednesday at 9 a.m.

Through his lawyers Nelson Havi, John Khaminwa and Julie Soweto, Miguna had sued the government.

In their submissions, the lawyers also filed for the court to block Miguna's deportation.

He had also sued Interior Cabinet Secretary Fred Matiang'i, Inspector General of Police Joseph Boinett, Immigration director Gordon Kihalagwa, Director of Criminal Investigations George Kinoti and the Attorney-General.

Law Society of Kenya has since also condemned the state for blocking the entry of the outspoken lawyer urging the Immigration department to provide paperwork to facilitate his entry.

Speaking to Citizen TV, Miguna's lawyer Cliff Ombeta asserted that the Canadian lawyer will not be signing the papers presented to him by the Immigration Department that require him to apply for a new visa.

"The court was clear when it declared directives by Interior CS Fred Matiang'i and Immigration director Gordon Kihalangwa null and void. Thus, signing any readmission form is a violation of the same orders," Ombeta stated.

Ombeta also noted that the historic handshake between President Uhuru Kenyatta and the Opposition boss was intended to bring peace and reconciliation yet the self-proclaimed general is suffering because of it.

"We were at the airport with Raila who tried to intervene but it was in vain. If the handshake was to kick-start reconciliation and healing, how come we are witnessing such things?" he asked.
