Wajir Businessman Mohamud Sheikh Files Petition to Have Matiang'i Removed From Office

Wajir businessman Mohamud Sheikh on Tuesday afternoon filed a petition in Parliament seeking the removal of Interior Cabinet Secretary Fred Matiang'i from office. 

Mr Sheikh accused the CS of violating the Constitution and constantly ignoring court orders.

His applications come hours after Matiang'i appeared before the Parliamentary Committee on National Security and Administration to give a report surrounding the dramatic deportation of the self-proclaimed NRM-K general Miguna Miguna.

Addressing the committee led by Kiambaa MP Paul Koinange, Matiang'i refuted claims that he had defied court orders claiming that he had not been served with any court order by any lawyer(s).

The CS, together with Inspector General of Police Joseph Boinnet and Immigration PS Gordon Kihalangwa, were on Thursday convicted for contempt of court. 

In his ruling, High Court Judge George Odunga stated that although he could not find Matiang'i, Boinnet and Kihalangwa unfit to hold public office at the moment, but his announcement that they had violated Article 10 of the Constitution had opened a way for any citizen to petition for their removal. 

"The three officials have conducted themselves in the most despicable manner and the most appropriate order is to issue a declaration they have violated Article 10 of the Constitution for repeatedly disobeying court orders to release Miguna,” Odunga ruled.

According to Article 10 of the constitution, if a person is found to have violated the principles, they can be deemed to have failed the leadership and integrity test provided in Chapter Six of the Constitution and be declared unfit to hold public office.

Matiang'i, while addressing the lawmakers, further exclaimed: "The reason why Inspector General of Police Joseph Boinnet did not present Miguna to court is that he was not in his custody. Miguna was not arrested by the police. He was being detained by the airport," affirmed Matiang'i.

The CS went ahead to explain how Miguna could easily apply to have his Kenyan citizenship regularised online allowing him to get back to the country.
