Senator Kithure Kindiki Sued for Violation of Land Agreement

Tharaka Nithi Senator Kithure Kindiki and his wife Joyce Kindiki risk being arrested and subjected to civil trial for failure to honour a land agreement. 

The legislator was sued by Peter Muriithi who in 2015 sold his piece of land to the couple's company, Intercity Group Ltd, but was only paid Ksh 17.1 million instead of the initially agreed figure of Ksh21 million. 

Mr Muriithi states that he had sold the 20-acre land to raise money for medical treatment for heart and diabetes, which has since resulted in the amputation of his left leg.

However, he claims he needs the Ksh 3.9 Million arrears to seek specialised treatment in Germany. 

The lawmaker's company was ordered to pay him the balance within 90 days in 2017 but they defaulted the order. 

Through Chief Magistrate Maxwell Gicheru of Embu, the court ordered Kindiki to pay Mr Muriithi Ksh7.1 million, which included the balance and liquidated damages of Sh 1.7 million, interest and cost of the suit. 

The company, however, filed an appeal at the High Court in Embu seeking a reversal and setting aside of the judgment by the Magistrate Court. 

In its defense, Intercity Group alleges that it is still interested in paying up.

In a statement, Moses Kindiki, the company director exclaimed: "There were issues relating to the financing and other inconveniencing developments that hindered payment of the balance of the purchase price."

According to a letter seen by Standard Digital from the Registrar of Companies dated October 10, 2017, the Senator and Joyce Kindiki co-own Intercity Group, each holding 300 ordinary shares.
