Punishment IEBC Commissioners Should Be Subjected to - Nelson Havi Explains

Advocate Nelson Havi on Monday noted that Independent Electoral and Boundaries Commission (IEBC) officials should be subjected to a public trial.

Commenting after the resignation of three of the officials, Havi exclaimed: "I still hold the view that all IEBC Commissioners and the entire Secretariat: Chebukati, Connie Nkatha Maina and Ezra Chiloba amongst others, require a people’s public trial at Uhuru Park. Their replacement alone will not be sufficient."

Speaking to Kenyans.co.ke, Havi stated that the only way Kenyans will get justice is if they take up justice in their own hands.

"Since court trials take years to give a verdict. It is only fair for Kenyans to put these officials under a public trial.

"Undoubtedly, the commission is rogue. We, therefore, need the public trial to ensure that they don't end up spending four years in the commission," asserted Havi.

Havi also explained to Kenyans.co.ke that the public trial will involve citizens (who can fit the Uhuru Park) who in turn will pick on a few individuals who will then now lead the hearing and prosecution of the individuals involved. 

According to the outspoken lawyer, 'when' the officials will be found guilty, they will be required to serve a sentence as ruled by the individuals speaking on behalf of the entire public as well as relinquish all property acquired while they were public servants.

Additionally, Political Analyst and lawyer Bob Mkangi told Kenyans.co.ke that any Kenyan can see to it that the remaining commissioners leave office.

According to Mkangi, citizens can remove the officials through tribunal to investigate allegations levelled against them by any Kenyan and if found at fault, they will be compelled to vacate office.

"Request them to vacate office through avenues that display public dissatisfaction and aversion to their continued stay in office( picketing and demonstrations)," he added.
