Lawyer Ejected Trying to Serve Court Orders During Senate Committee Hearing

There was drama on Monday when a lawyer trying to serve court orders to a Senate committee was thrown out of Parliament.

Lawyer Nicholas Nyamai appeared before the Senate Public Accounts and Investment Committee which was investigating a controversial multi-billion piece of land in Ruaraka and tried to serve the orders.

The Senior counsel representing two firms claiming to own the piece of land obtained a court order by High Court Judge Lady Justice Pauline Nyamwea to bar Senate from investigating the matter.

He presented the orders, much to the irk of the senators led by Homa Bay Senator Moses Kajwang who instructed that he be removed from the room.

Nyamai's pleas to be pardoned fell on deaf ears as the Sergent at Arms ejected him from the premise.

Following the incident, Senator Kajwang' insisted that they would still investigate the matter despite the court order.

"Senate draws its powers to summon witnesses from the Constitution. This is reinforced by statute. We shall not hesitate to defend the honour of Parliament and to deal firmly with distractions and disorder in committees," he affirmed.

Earlier in January, the government made a partial payment of Ksh1.5 Billion to two firms: Afrison Export-Import Limited and Huelands Limited who claimed were the genuine owners of the parcel.

The two firms claimed Sh3.2 billion compensation for 13.7701 acres where Ruaraka High School and Drive Inn Primary School are built.

Appearing in a previous committee hearing, Francis Mburu, the director of Hue Lands Ltd and Afrison Imports and Exports Ltd accused senators of having an ill motive in their grilling.
