Machakos Governor Alfred Mutua's Election Nullified

Dr Alfred Mutua's election win as Machakos Governor was on Friday nullified by the Court of Appeal.

Issuing the ruling, Judge William Ouko, ordered the Independent Electoral and Boundaries Commission (IEBC) to conduct a free and fair gubernatorial election in the County.

"Machakos gubernatorial election results declared by the returning officer failed the Constitution test and could not be verified," Justice Ouko stated.

After the ruling, Wavinya Ndeti who contested Mutua's election stated: "I thank God it has come to pass, the people of Machakos voted for me and today it has been proved I won."

On his part, Dr Mutua disclosed that he would move to the Supreme Court to challenge the result.

"We will still be in office until the Supreme Court rules otherwise. The court didn't cover the issue of validity.

"It is very clear that the Court of Appeal misunderstood the whole case. They had some findings that are not clear where they got them from- they look like factual errors," he stated.

Seemingly calm, he added: "We are still continuing with work. I assure Kenyans that I will still be in the ballot papers come 2022 and I will be the 5th President of Kenya- these are just small hurdles and it cannot kill my spirit I want the better for the people of Kenya."

Earlier in February, High Court Judge Aggrey Muchelule upheld Mutua's victory and ordered Ms Ndeti to pay costs amounting to Sh5 Million to the Governor and an equal amount to IEBC.

He stated that the petitioner had failed to furnish the court with proof of any irregularities or illegalities that she claimed to have happened during the contested polls.
