The High Court in Nairobi allowed the resumption of a case challenging the authenticity of academic credentials of Taita Governor Granton Samboja.
Governor Samboja had been accused of forging a university certificate and used it to contest in the 2017 elections.
The Ethics and Anti-Corruption Commission (EACC) returned to court, seeking to have a lost file reconstructed so that the case can resume.
High Court judge Justice Wilfrida Okwany heard the application by EACC lawyer Jackie Kibogy where she stated the file could not be traced in the court registry for 60 days.

Justice Okwany set the hearing for October 9 after Kibogy claimed EACC had established that Samboja was culpable.
Samboja was named as the first respondent while the Independent Electoral and Boundaries Commission is the second.
The matter first featured in the election petition against Samboja's victory when Kenyatta University denied having anyone by Samboja's name that earned the alleged degree certificate at the institution.
KU and rights crusader Mwambi Mwasaru are first and second interested parties in the application.
According to Samboja, he holds a Human Resource Management degree from KU which he was awarded in 2009.
Kenyatta University, however, disowned the Governor's sentiments through a letter signed by then acting vice chancellor Prof Paul Wainana.

"This is to inform you that there are no records in the university to indicate that Granton Samboja of ID number 1254***1 was a student of Kenyatta University and graduated with a Bachelors degree in 2009," part of the letter read.
