Taita Taveta Governor-elect Granton Samboja in Suit Against EACC

Taita Taveta Governor-elect Granton Samboja has moved to court seeking to bar the Ethics and Anti-Corruption Commission (EACC) from pursuing a case against him.

Mr Samboja is seeking to have the courts block EACC from conducting further investigations, arrest and prosecution over his academic papers.

The politician's lawyer told the courts that Samboja has been living in fear since the anti-corruption body declared that he was guilty of the forgery charges, calling for his immediate arrest and prosecution.

He further accused the EACC of forcefully obtaining documentary evidence from him, contrary to provisions of the law.

Samboja claims that the EACC wrote to the Director of Public Prosecutions (DPP) seeking his arrest long after he had been cleared by the IEBC to vie on a Wiper Party ticket.

He adds that the move is in breach of the due legal procedure concerning such cases and is a misuse of the DPP’s prosecutorial powers.

The EACC has accused Samboja of forging academic certificates and using the same to gain admission into a master’s degree course at Kenyatta University.

They additionally claim that he provided false information on the self-declaration form provided to the IEBC which, in their view, amounts to corruption.

EACC, DPP, Inspector General of the National Police Service and the Attorney General have been named as respondents in the case that was filed on Thursday.

Samboja is scheduled to be sworn in on August 22.
