Kilgoris MP Gideon Konchela's Election Nullified

The Court of Appeal has nullified the election of Kilgoris Member of Parliament Gideon Konchela.

Konchela's election was contested in court successful petition by Julius Sunkuli.

He was elected on a Jubilee Party ticket.

In February, the High Court in Kericho ruled against the former area MP Sunkuli’s petition upholding Konchela’s election.

Justice Martin Muya, in his ruling, dismissed Sunkuli’s application compelling the Independent Electoral and Boundaries Commission (IEBC) to pay Ksh2.5 Million in legal costs.

“The effect of the irregularities allegations and indeed some of which have been proved, I find do not by themselves amount for a declaration that the election was so badly conducted that there is a need for court intervention,” read the February ruling by Justice Muya.

Muya held that the irregularities that had been identified by the applicant could not alter the election result and hence dismissed the application.

Sunkuli at the time faulted the judgment and vowed to move to the Court of Appeal to challenge the Kericho High Court decision.
