Muhammad Swazuri Writes to Joseph Kinyua Over Replacement at NLC

Suspended National Lands Commission (NLC) chairman Muhammad Swazuri wrote to the Head of Public Service Joseph Kinyua over events that led to his arrest.

The protest letter written to the State House official claimed that his vice-chairperson Abigael Mbagaya was behind his arrest and suspension from the commission.

According to Swazuri, Mbagaya misinterpreted an order issued by the judge asking the NLC official not to go back to his office pending the trial of the corruption case against him.

The embattled commission chair argued that it was unconstitutional for the lands body to appoint a replacement when he had not been removed from the position.

"Article 250 and 251 is clear on the process of appointment and removal/vacancy of the office of chairperson.

"The fact that the person reportedly taking over as chairperson of the NLC not only orchestrated my arrest but we have evidence of her corrupt acts as Vice Chair, make it untenable to allow this state of affairs to continue," his letter read in part.

He further detailed that the judge had barred him from going back to his office based on information given by Mbagaya.

"A day after my release on bail, the magistrate ordered that I should not go to my office unless accompanied by a police officer and after consulting with the ‘new management.’

"That order has apparently been translated by the Vice Chairperson to mean I have been suspended or interdicted," the letter noted.

Swazuri went on to plead with Mr Kinyua to investigate the claims and require an explanation from the new team leading the commission over the alleged unlawful replacement.

"My fervent request is that you urgently intervene in this matter in seeking answers to the reasons for the infringement of my constitutional rights by the EACC officers as well as assist in addressing the issue of my ostensible removal from office," he pleaded in the letter.
