Politician Boni Khalwale on Thursday challenged Chief Justice David Maraga to explain why DCJ Philomena Mwilu's case was not handled by the Judicial Service Commission (JSC).
In a post on his social media, the former Kakamega Senator noted that other disciplinary cases were handled by the commission rather than being subjected to a public court hearing.
"When Nancy Baraza was accused of abuse of office, when Justice Tunoi faced bribery accusations, their matters were processed through the Judicial Service Commission.
"CJ Maraga must now disclose why the same standard was not applied in DCJ Philomena Mwilu’s case," he stated.
A section of Kenyans seemed to agree with Khalwale's remark noting that the arrest was politically instigated.
"Simple! Because the Mwilu's issue was 98% political and someone just decided to fulfil their promises of revisiting the SCoK," one user wrote.
"It's called double standards. Some animals are more equal than others - The Animal Farm replay," another stated.
"The DPP “thought” they were criminal offences yet they were civil offences...just drama or sabotage to ruin DCJ Mwilu reputation!" one Kenyan observed.
Others were of a different opinion, stating that it was only fair for graft suspects to be subjected to the same procedure.
"This is a war against graft, Kenyans are tired of special treatment to suspects, nobody is special! Let all go through the same process! As graft suspects," a netizen fired back.
Echoing the sentiment, another conveyed: "Simple, there's a new Sheriff in town. Secondly, there's a new order. Leaving office is not enough, people must face the consequences of their actions, Daktari!"
