High Court Reverses Ruling Ordering Cyrus Jirongo to pay Ksh 700 Million

The High Court on Thursday reversed the decision requiring former Lugari MP Cyrus Jirongo to pay a debt of Ksh 700 million to a businessman.

The decision by the court comes after the politician filed a petition arguing that he was not accorded room to defend himself after learning of his earlier fate through the media.

“That the default judgment entered herein against the 2nd defendant on July 28, 2014 is hereby set aside, thereby giving the 1st defendant leave to defend this suit,” ruled Justice Sewe.

Properties belonging to Sammy Boit Arap Kago, registered under eight companies, were auctioned after Jirongo reportedly failed to pay the cash which was a loan given to him with the assets used as security.

According to Jirongo, he was not served with the notice of entry of the judgment pointing out that the warrant of his arrest by the law firm of Rachier and Amollo advocates was illegal considering they were not on record for the case.

He revealed that his signatures were forged in the alleged deal to pay back the money to Kago.

The embattled politician affirmed that he had at no point borrowed money or sought security from Kago’s properties.

The new court ruling has removed the risk of Jirongo being declared bankrupt again.

On September 20, the former Lugari MP was released from police custody after Devolution Cabinet Secretary Eugene Wamalwa managed to secure his release.

CS Wamalwa gave his sleek Mercedes Benz as surety for the 2017 presidential elections candidate.

Deputy President William Ruto also came to his rescue after donating Ksh 2 million to bail him out.

History between the Deputy President and Jirongo can be traced back to the early1990s when they both belonged to a lobby group popularly known as the ‘Youth for Kanu 92'.
