Makueni Senator Mutula Kilonzo Jr's former bodyguard was on Wednesday convicted for shooting into a crowd and injuring one person.
Shedrack Kioko Malekya, an administration police officer was found guilty of shooting Brian Mutua, an assembly orderly, during a 2014 scuffle that occurred at the Makueni county assembly premises.
Makueni Senior Principal Magistrate James Mwaniki ruled that Kioko was among several bodyguards who fired shots on the crowd.
The court heard that the bodyguard shot Mutua in close range, evidence that made the judge single him out.
Delivering his verdict, Justice Mwaniki stated that Kioko could not justify the use of a firearm during the incident where he injured the orderly on his stomach.
Through his lawyer, Kioko pleaded with the court to be lenient in the sentencing arguing that he had a sickly father to take care of.
Three of the co-accused were however lucky to be released with the judge finding that they were justified to use their weapons as the crowd which had accompanied Governor Kivutha Kibwana posed a threat to the legislators.
The court acquitted Ndunda Muthoka, Mackline Francis Daido and Nicholas Lumbu Musyoka, the bodyguards of former Assembly Speaker Stephen Ngelu, former Assembly Majority Leader Francis Mutuku and former Kaiti MP Richard Makenga respectively.
The magistrate could not establish which of the officers was responsible for the injuries sustained by the victims including the current assembly Speaker Douglas Mbilu.
Others who sustained gunshot wounds are Mr Yakob Abdirazak Bule, Mr Francis Mutisya, Mr Festus Nyamai, and Prof Kibwana’s bodyguard Mr William Kinoti.
