Duale Takes on CJ Maraga Over Hijab Ban

Majority Leader Aden Duale has taken issue with the Supreme Court after it overturned a ruling allowing Muslim students to wear hijabs in school.

Speaking in Garissa on Saturday, Duale stated that Kenyans with different religious affiliations should be allowed to dress as prescribed by their faiths.

He urged Muslims all over the country not to worry about the recent Supreme Court ruling saying they have rights like other Kenyans.

“Supreme Court is a creation of the Constitution. The same Constitution that gives us the right of [sic] wearing hijabs for our girls is the same Constitution that created the Supreme Court.

“It’s the same parliament where I lead, that vetted those judges starting with the Chief Justice. Between God and 7 human beings, we believe in God,” he stated.

The Garissa Township MP asked the top court to stick to hearing election petitions and stay away from religious matters.

While ruling on a petition filed by the Methodist Church of Kenya on Thursday, the Supreme Court stated that every school has a right to determine its own dress code.

The decision was delivered by Justices David Maraga, Mohammed Ibrahim, Njoki Ndungu and Isaac Lenaola.

Justice Jackton Ojwang is the only Supreme Court judge who dissented and supported the decision allowing the wearing of hijabs.

The ruling has elicited strong reactions from the Muslim community with their leaders describing it as discriminatory and unfair.
