31 Judges in Trouble Over Gross Misconduct

Over 30 errant judges are at risk of being sacked by the Judicial Service Commission (JSC) for gross misconduct.

The 31 judges are being investigated over various claims ranging from corruption and bribery, interfering with justice, insubordination, breach of the code of conduct and work ethics and gross misconduct.

“As at January 2019, the commission was seized of 69 complaints against judges of the superior courts.

These complaints were considered and 13 admitted for hearing while 18 other petitions are at an advanced stage of consideration,” JSC mentioned in a statement.

On disciplinary issues against errant magistrates, the commission disclosed it heard and determined nine cases.

Of the nine, JSC dismissed five magistrates for issuing illegal orders that led to demolition of people’s houses.

The magistrates also had vast and unexplained sources of wealth.

On Tuesday, the Supreme Court upheld the decision by a tribunal to remove former High court judge, Joseph Mutava from office.

The five-judge Supreme Court bench found that Mutava had influenced the Goldenberg case placed before him.

Mutava was found unfit to serve in the judiciary by a tribunal formed to investigate his conduct after he was found guilty of gross misconduct.
