A man from Wajir, Mohammed Mohamud Sheikh, who was seeking the removal of four Supreme Court judges over gross misconduct has now filed an application to withdraw it.
Sheikh wishes to withdraw the petition that he filed early this month, "wholly, voluntarily and without condition."
“The petitioner prays for the withdrawal of the petition dated March 13, 2019, and disregard of the averments therein," Sheikh stated.
He had sought the removal of Justices Mohammed Ibrahim, Jackton Ojwang, Smokin Wanjala and Njoki Ndung’u for violating the Constitution during the Wajir gubernatorial petition.
He did not give details on why he wanted the petition removed.
Sheikh had made the petition alongside other petitioners who are unhappy with the judges.
Lawyer Ahmednasir had also filed a petition against judges Jackton Ojwang', Smokin Wanjala, Mohammed Ibrahim and Njoki Ndung'u.
The lawyer accused the judges of pocketing more than Ksh390 million to influence the outcome of the appeal, where he represented former Wajir Governor Ahmed Abdullahi.
The judges are also accused of breach of the Judicial Code of Conduct and breach of Ethics and Oath of Office.
