Neno Evangelism head, Pastor Maina Ng'ang'a, moved to court on Monday seeking to halt his latest case in which he allegedly swindled Ksh3.6 million from a Nairobi-based businessman.
The embattled pastor, through his lawyer, argued that he had been the subject of untold mental and psychological anguish and torture at the hands of the Directorate of Criminal Investigations (DCI) and the Director of Public Prosecutions' office (DPP).
He then went on to name businessman Wickson Njoroge Mwathi, the Inspector General of Police, DCI and the DPP as respondents in the case.
"The planned prosecution is a contravention of my fundamental right to fair trial, fair administrative action and thus amounts to an abuse of the legal process," he asserted.
Pending the hearing and determination of his petition, Pastor Ng'ang'a pleaded with the court to stop the DPP from prosecuting him.
He further argued that his respondents were only using Mr Mwathi as a tool to settle personal scores and grudges.
Mwathi had claimed that the Neno Evangelism Centre pastor had blatantly refused to refund Ksh3.6 million in an abortive house lease agreement.
The businessman reported the matter to Central Police Station and the case was booked under OB 50/20/5/17.
Pastor Ng'ang'a, who is currently out on bond, claimed that Mwathi's move to prosecute him was just a show of force and unlawful pressure from his would be detractors.
The Ksh3.6 million in question was allegedly meant for a house lease deal that would see the preacher rent out his 7-bedroom house to Mwathi for a period of six months.
The complainant then claimed that the preacher reneged on his end of the agreement soon after receiving the amount paid to him on April 6, 2016.
