Five Nigerians went to court on Friday to bar Interior CS Fred Matiangi from declaring them illegal immigrants.
The five, Munirudeen Adedamola Safu, Aliu Adewale Safiu, Fatai Oshodi, Musa Odeyoyis, and Oluwafemi Akinmoyero are due for deportation.
They are seeking to stop their expulsion from the country until the determination of the case.
Through their lawyer, the foreigners argued that they had fulfilled every requirement as stipulated in the Kenyan constitution and deportation would be a violation of their rights and the rules of natural justice.
The five went on to explain that they had complied with the requirements of the government as they had the Alien ID and work permits from the immigration department.
Named as respondents alongside CS Matiang’i in the case are the Director of Immigration, Attorney General, Directorate of Criminal Investigations and Officer Commanding Station Kasarani Police Station.
“In the exercise of the powers vested in me by Section 33 (1) (d) of the Kenya Citizenship and Immigration Act 2011, do hereby declare that the entry or presence of the five is unlawful and they are members of a prohibited class and immigrant,” Matiang’i had declared in a statement.
This comes barely a day after 33 other Nigerian illegal immigrants were arrested in Kasarani for allegedly peddling drugs.
The 33 were nabbed in an operation led by the Kasarani DCIO which also saw the owner of a popular night club behind TRM arrested for helping the Nigerians.
They were claiming to be students from the nearby Universities (USIU and KU).
