Why Fate of New Currency Lies With Maraga

A case filed by activist Okiya Omtatah over the legality of the new generation banknotes has been referred to Chief Justice David Maraga.

Justice Weldon Korir while making the ruling, revealed that the matters raised in the petition raised substantial questions of the law.

He then referred the matter to the CJ for him to empanel a bench that would listen to the matter and make a ruling.

Omtatah had gone to court to challenge the implementation of the new generation banknotes stating that some of its features contravened the constitution.

Speaking to the media about his petition, Omtatah suggested that the statue should not be included in the new currency notes as the constitution stipulates.

He also stated that there was no public participation as requested by the law in the entire process.

On Monday afternoon, the Governor of the Central Bank Patrick Njoroge came out to defend the notes over claims that they had sneaked back the founding father through his statue.

He further explained that the new features were unique and that they could make it easier for visually impaired citizens to use the currency.

Omtatah was also of the opinion that the order to demonetise all old Ksh 1000 notes by October 1 was illegal.

He argued that both the new and old notes of all denominations were supposed to run concurrently until such a time that they (old notes) would no longer be in circulation.
