Embattled lawyer, Miguna Miguna, on Friday, took legal action against interior CS Fred Matiang'i and 24 other government officials following his Kenyan citizenship denial.
In the court documents seen by Kenyans.co.ke, the lawyer, who resides in Canada since his deportation in February 2018, argued that he has never renounced his Kenyan citizenship but was forcefully kicked out of the country.
He further added that he had the right to be in the country considering that he was born in Kenya.
“At the time, Miguna was unlawfully issued a Kenyan passport while he was working as an adviser to the then Prime Minister Raila Odinga,” read the document in part.
To prove his case, he stated that during the years he studied at Nairobi University, he was the student leader and got subjected to torture for expressing his political opinions.
The state had earlier argued that Miguna left the country in 1998 after he got expelled from the University.
It was during his exile years that he reportedly acquired his Canadian citizenship.
He, however, refuted the claims explaining that he went to exile for fear of persecution and that his Kenyan passport was destroyed and property removed without his knowledge.
Miguna also claimed that he was physically assaulted, abducted and detained under cruel, inhumane and degrading conditions for six days while holed up at Githunguri Police Station.
Some of the respondents in the suit include the Attorney General, Principal Secretary of the Directorate of Immigration and Registrations of Persons, Director of Criminal Investigations, Director of Public Prosecutions and Director of Immigration and Registration of Persons.
