A 29-year-old man was handed an unfavourable punishment by a High Court in Nairobi after he sued his father demanding Ksh2.8 million to pay for his masters.
Allan Njau Waiyaki had sued his father, Eddie Waiyaki Hinga for the school fees despite having a successful petroleum business.
The Standard on Monday, September 30 reported that Justice Aggrey Muchelule dismissed the case and further ordered Njau to pay his father the cost of the suit.
Njau wanted the money in order to study a masters in terrorism and security studies.
Muchelule noted that since he had attained his undergraduate degree courtesy of his father he was not entitled to any other assistance.
In his argument, Njau claimed that his father was rich and he bore equal responsibilities as his mother to take care of him further revealing that his mother had given him Ksh2.6 Million for upkeep.
Waiyaki told the court that he had taken care of his son and educated him until the age of 22, adding that the son was a shareholder of a firm that was granted retailer status by Vivo Energy Kenya and that he had gotten Ksh2.9 million as profit.
The two have been embroiled in a legal battle for the past six years as the case was thrown out of the magistrate's court.
“It is against my right to education for my father to discontinue my education prematurely. The respondent is a man of means and he has the ability to educate me,” Njau argued.
He further stated that his parents had set a high standard for him and therefore they had the responsibilities to promote his social progress.
Justice Muchelule ruled that parental responsibility ceased after an 18-year-old attained his first post-secondary certificate.
