Uhuru, Ruto Lose Ksh 180M Court Battle

President Uhuru Kenyatta and his deputy William Ruto missed out on bagging over Ksh180 million after the Court of Appeal overturned a High Court ruling ordering three civil rights groups to pay the duo.

According to a report by The Standard on Wednesday, November 13, the activists had challenged Kenyatta and Ruto's eligibility to contest the 2013 General Election.

They cited that the duo was facing charges of crime against humanity at the International Criminal Court (ICC).

The groups further wanted the IEBC barred from accepting the Jubilee leaders' nomination papers. 

Justices Daniel Musinga, Gatembu Kairu and Agnes Murgor ruled in favour of the rights groups.

Kenya Human Rights Commission, the International Commission of Jurists-Kenya Chapter and International Center for Policy and Conflict were found to have made no offence against Ruto or Kenyatta. 

On Saturday, November 9, Suba North MP Millie Odhiambo, however,  posted on her Facebook page that the president had served ICPC and KHRC with a bill of Ksh60 million.

DP Ruto also reportedly served the same organisations with a bill of Ksh30 million while IEBC served a bill of Ksh23 million.

"Public interest litigation is for the public benefit and not entities that instituted the proceedings. Condemning them to pay huge costs can become a deterrent and more likely will make people shy away from filing suits to defend the constitution for fear of being punished with costs.

"They had a genuine concern on the threat to the office of the president and deputy president with Kenyatta and Ruto facing criminal proceedings at the ICC," the judges ruled.
