Govt Hit With 1-Day Ultimatum on Miguna

A Nairobi court on Wednesday, January 8, gave the government one day to file an affidavit in response to accusations of contempt of court in the matter of self-declared National Resistance Movement (NRM) leader Miguna Miguna.

Justice Weldon Korir asserted that the orders he gave on Monday, January 6, compelling state officials to facilitate Miguna's re-entry to Kenya and to return his valid passport were still in force.

Miguna's lawyer John Khaminwa wants the respondents to be found guilty of contempt of court for what he described as failing to ensure Miguna's scheduled return on January 7, was not interfered with.

"I objected to state counsel because I wanted them to be found guilty of contempt of court. Miguna is not home.

"They are making an argument that because Miguna was not in Kenya the matter was not in their hands," he told Kenyans.co.ke.

The case will come up for hearing on Friday, January 10.

The fiery advocate, deported to Canada in 2018, was barred from boarding two different flights to Nairobi; one from Frankfurt, Germany and another from Paris, France.

In both instances, the airlines (Lufthansa and Air France respectively) explained that they had received requests from the Kenyan government not to allow Miguna on board.

"The Kenyan Authorities require airlines to send passenger data to them in advance before every flight departs to Kenya. In the case of this passenger, they requested that Lufthansa deny boarding.

"However, we are trying to help him in whatever way we can," the airline wrote in response to various queries.

Khaminwa told Kenyans.co.ke that they would file a petition against the two airlines this week, accusing them of violating international human rights norms.

"The perception the airlines are giving the public is that Miguna is an international criminal, and they are tarnishing his name and we intend to proceed against them. Under the international human rights norms that is unacceptable, they got money from Miguna," he argued.
