CS Karoney Sued Over Land Scandal

Lands Cabinet Secretary Farida Karoney was sued for allegedly issuing a title deed for a contested piece of land.

Kandara Residence Association also sued top lands ministry officials in the Ksh 3 billion deal that saw the buyers deceived into purchasing public land in Kiambu county.

Also being sued are the Director of Survey, the National Lands Commission, Chief Lands Registrar, Del Monte Ltd, Director of Planning and the Chief Executive for Lands in Kiambu County.

The suit was filed at the Land and Environment court in Thika on Wednesday, June 10 and is set for hearing on Wednesday, June 24. 

Del Monte Kenya Limited claimed to own the piece of land without having proper documentation including a letter of allotment, evidence of payment of fees, stamp duty, or certificate of lease.

Kandara who are claiming to be the rightful owner of the parcel of land accuses Del Monte of transferring the land to Ananas Holdings Limited.

The association also have documents in their possession that indicate Ananas has embarked on sub-division and later saleof the plots.

Ananas moved to divide the land into 47 plots which have since been sold at a lumpsum of Ksh. 60 million and Ksh. 90 million earning the company over Ksh. 3 billion.

Kandara also claims to have documents indicating payment of land rates on Thursday 2 January 2020 to the Kiambu County Government.

The association argues that the land was transferred illegally to Ananas as after the land was marked public the ministry officials initiated a process of converting it in order to come up with a new Land Reference (LR) Number.

Back in March 2019, the National Land Commission (NLC) ordered a resurvey on the land to establish if there is any variance between land leased and the land Del Monte occupies.

The commission also noted that deficit, if found should be surrendered to Kandara for resettlement and the county governments for public purpose in the ratio of 70:30 respectively.

If a deficit was not found then on the expiry of the lease a suitable amount of land should be set aside and held in trust by the county governments for purposes of resettlement and public utilities.

Karoney and director of land administration Edward Kosgei were also sued in February 2020, after Paul Gachie accused them of contempt of court.
