Nyali MP Mohammed Alias Moha Jicho Pevu on Tuesday, June 23, wrote to National Assembly Speaker Justin Muturi with new evidence to support his bid to impeach the Cabinet Secretary.

Ali's move came after Muturi delivered a ruling on the floor of Parliament on Ali's proposed motion, disallowing it due to lack of evidence.

The MP had moved to impeach the CS over the directive that all cargo imported through Mombasa be hauled via the Standard Gauge Railway (SGR) to the Naivasha Inland Container Depot (ICD).

Accusations he initially leveled included corruption scandals at the Ministry of Health during Macharia's stint at Afya House and links to alleged impropriety at Suraya Property Group. In his latest letter to Muturi, however, Ali focused on controversial contracts signed at the Ministry of Transport.

The impeachment motion had already appeared to be faltering when several MPs whose names appeared on a list of MPs supporting the motion disowned the list.

Ali promised to share the evidence in his possession with the public after a press conference scheduled for Wednesday, June 24.

Issues he cited include the Friday, June 19 Court of Appeal ruling that declared the entire Standard Gauge Railway (SGR) contract between Kenya Railways and China Road and Bridge Corporation illegal.

A three-judge bench composed of Martha Koome (presiding), Gatembu Kairu and Jamila Mohammed ruled in favour of the petitioner; veteran activist Okiya Omtatah who had observed failure to comply with procurement laws in the SGR lead.

Ali expressed confidence that he had gathered enough evidence to oust Macharia, accusing him of ruining lives and the economy of the Coast region due to his actions.

"In this regard, therefore, I wish to forward the relevant documentation of evidence enclosed herewith in support of my motion.

"Folio 1 - Illegal port contract and Names of Beneficiaries

"Folio 2 - Illegally acquired land belonging to farmers sold to the current shareholders of the Kedong' Ranch Limited now popularly referred to as the Naivasha Inland Container Depot (ICD)

"Folio 3 - Court of Appeal ruling on the Standard Gauge Railway (SGR)

"Folio 4 - Fraudulent contract of Kipevu Oil Terminal

"Folio 5 - Illegal contract documents including the Health Scandal documentation and loss of billions in shillings on various projects in the House at the appropriate time

"I shall also table many other documents including the Health Scandal documentation and loss of billions of shillings on various projects in the House at the appropriate time," the letter seen by Kenyans.co.ke read in part.

Ali called for Muturi to allow the impeachment motion to proceed in light of his new evidence.
