A Belgian woman, Dysseleer Mireille, mysteriously disappeared 13 months ago erupting a vicious fight for her Ksh100 million property.

According to a report by The Standard, the suit filed by a lawyer, Hari Gakinya, over the distribution of the estate hit a snag after a court blunder occurred that included undelivered emails.

Gakinya is said to have presented a will from Mireille in court that Nakuru Justice Teresia Matheka directed Sergeant Franklin Kiraithe, a detective with the Serious Crimes Unit, to probe.

Kiraithe was scheduled to present his findings in court in July but improper service delays showed that he received the summons in October 2020.

“Sergeant Kiraithe should be served properly with the summons to make an appearance for the case in question.

"Even though Kiraithe was to appear in July, details show that the deputy registrar served on October 2,” stated the Matheka.

The judge also noted that the service was not properly done because that specific summon was sent via email that was not delivered to Kiraithe's inbox.

Matheka, therefore, ordered deputy registrar of the High Court to serve the summon to Kiraithe and adjourned the hearing of the case to November 2, 2020.

Kiraithe had earlier been directed to give evidence and was later summoned after he failed to file a report on his findings.

He had been directed to probe the authenticity of Mireille's will presented in court, last testament and bank account.

Kiraithe had previously presented a report noting that Mireille's death certificate was fake.

So far, the widow's disappearance has been ruled as murder with a case currently ongoing at the Milimani Law Courts.
