Makueni-based teacher, Esther Nthenya, who grabbed national headlines as the woman who was in the company of former Machakos Senator Boniface Kabaka was on Thursday, January 28 set free after murder charges were dropped.
A Nairobi court found Nthenya had no case to answer and that there was no foul play in the collapse and subsequent death of Senator Kabaka.
The Office of the Director of Public Prosecutions (ODPP), through its counsel Abel Omariba said that after analysis of the report from the government chemist they could not find sufficient evidence to hold the suspect.
Nthenya was arrested in December 7, 2020 and released on bond after the lab reports indicated that Kabaka was not poisoned as suspected.
The Senator passed away a few days late on December 11, 2020 at the Nairobi hospital.
He had been taken to the Hospital's ICU department in critical condition on December 4.
His family said that he succumbed to a stroke, ruling out reports that he died of Covid-19 or drug overdose as earlier speculated.
Speculations surrounded the cause of death, with Wiper Party Leader Kalonzo Musyoka, calling for sensitivity while reporting on the matter.
Before his death, Kabaka was vocal about a piece of land that some individuals wanted to grab.
Nairobi Governor Mike Sonko had also claimed, without evidence, that the deceased politician was assassinated due to land issues.
"We know what you (his assassins) did and I want to tell other leaders that if they continue to keep silent about such matters, they will be next in line," Sonko claimed while speaking at the Senator's funeral on Tuesday, December 22.
Kabaka had undergone a surgical operation to remove a clot in his brain, which according to Kalonzo is not usually an easy thing.
Former Machakos Senator was buried in his ancestral home at Masinga, Machakos County on December 22.
The Machakos Senatorial by-election is slated for March 18,2021 when voters will elect Kabaka's successor.
The Independent Electoral and Boundaries Commission this week released a list of the 11 candidates who have been cleared to run for the seat.
