The appointment came a week after Ouko was nominated by the the Judicial Service Commission.

The commission interviewed six other candidates including; Justice Said Juma Chitembwe, Justice Marete Njagi, justice Matthews Nduma, Justice William Ouko, lawyer Alice Yano, Justice Sergon Joseph Kiplagat and Dr. Nyaberi Lumumba.

Ouko has been an appellate court boss since March 2018.

He will replace Judge Jackton Ojwang who retired in February 2020 when he reached the mandatory retirement age of 70.

The judge has risen from the lowest-ranked judicial cadre of a district magistrate to make history after being nominated by the Judicial Service Commission panel.

Some of his classmates has described him as a humble person who calls them by their names when he visits the village.

Judicial Service Commission (JSC) Commissioner Macharia Njeru praised Ouko for his humility yet tough stance on matters regarding judicial independence.

"I'm impressed by your humility and of course you were one of the leading candidates for the CJ position and you have taken it in stride and a lot of humility," JSC commissioner Macharia Njeru stated.
