Why Obstructing a Train Will Get You 10 Years in Jail

Kenya Railways Corporation has issued a stern cautionary statement, warning against breaking rail traffic rules and regulations.

In the statement dated September 22, the corporation says culprits found guilty will face a jail term of up to 10 years.

“Kenya railways wishes to advise the public to exercise caution and high alert while crossing railway lines,” read part of the statement.

Continued rehabilitation of the railway lines across the country will lead to an increase in the use of meter-gauge freight and passenger trains.

Last year, the corporation noted an increase in inbound traffic across the country for freight and passenger trains.

Additionally, the corporation has urged motorists and Kenyans in general along the railway lines to strictly observe all the train traffic rules.

The corporation urged the public to adhere to provisions of the Kenya Railways Corporations Act (Cap 397), Section 66.

Any person who unlawfully engages in any act which obstructs, or might obstruct the operations of a train, vessel or vehicle of the corporation and which endangers, or might endanger...

“the life of any person travelling thereon; or damages or in any way interferes with any train, vessel, vehicle, signal, points, rails, sleeper, lighthouse, buoy, mark, beacon or other property of the corporation...

"in such a manner as to endanger, or as might endanger, the life of any person, shall be guilty of an offence and liable to imprisonment for a term not exceeding ten years.” the act stipulates.

Pedestrians together with motorists are requested to approach the crossing levels with care to avoid obstructing the oncoming train. 

Kenya Railways was quick to point out that it was a personal responsibility to observe all rail traffic rules while maintaining safety guidelines.

“While public safety remains a top priority for us, members of the public are reminded to have a personal responsibility,” Kenya railways stated.
