Exiled lawyer Miguna Miguna has taken on Former Chief Justice Dr Willy Mutunga over his promise to bring him back to the country.
In a social media post on his official Twitter account on Saturday, January 22, Miguna stated that he was still waiting for the emeritus Chief Justice and his entourage two months after the promise was made.
Miguna explained that it was necessary to demand that people keep the promises that they make.
"I'm still waiting for CJ Emeritus Willy Mutunga's arrival with his esteemed delegation that was scheduled to land at the Toronto Pearson on November 12, 2021.
"We must keep demanding that each one of us remain faithful to promises we give - from Uhuri to the villager," he stated.
In a publication in the Elephant on October 20, 2021, Mutunga revealed that he would travel to Canada to bring back the embattled lawyer after having consultations with various lawyers and human rights groups.
'After careful reflection and following broad consultations with lawyers, human rights and justice defenders, progressive politicians, and Mr Miguna himself, I have decided to travel to Toronto, Canada, to accompany Mr Miguna on his flight back to his motherland on 16 November 2021. I am also seeking out Kenyan journalists who will accompany me on this historic journey," he stated then.
The former CJ explained that his decision was informed by the government's defiance of court orders that had directed for Miguna to be allowed back into the country.
“I have taken this extraordinary step for two fundamental reasons. The first is because of the continued, flagrant and reprehensible defiance of the Government of Kenya, its agencies, and senior officials, against the numerous valid court orders in favour of Mr Miguna.
However, while in a TV interview on November 17, former Law Society of Kenya (LSK) President Nelson Havi explained that together with Mutunga, they were unable to travel to Canada as scheduled because of a delay in processing their visas.
"We were not able to travel. It took long for us to process our visas. Dr Mutunga's Canadian visa was released yesterday. There is no way he could have flown.
"My appointment for the German Embassy visa application was scheduled for the first of December. Next month. We must respect the protocol in other offices. We can't just force them to do our bidding," he explained.
This was after Miguna faced hurdles in his attempts to return to the country. Consequently, in a court ruling issued on November 22, 2021, by Justice Hedwig Ong'undi, the High Court judge ordered for Miguna to be issued with emergency travel documents by the Kenyan Embassy in Germany to enable Miguna to get back in the country.
"Once in possession of the emergency travel documents and upon presentation of the same to the second respondent (Air France), the latter should allow the petitioner applicant to board the available flight to Kenya with immediate effect," Ong'undi, ruled then.
