Miguna's Much Awaited Return Faces First Hurdle

Exiled Kenyan lawyer Miguna Miguna, who announced he would be returning back to the country on November 16, 2021, is already facing his first hurdle after commercial airlines were ordered not to fly him into the Kenyan airspace.

The red alerts, issued by the Kenyan government, have forced Miguna's lawyers to move to court and will have to await a decision before getting into a plane back to Kenya. 

Law Society of Kenya President Nelson Havi and former Chief Justice Willy Mutunga, have since planned to travel to Canada and accompany the former Nairobi gubernatorial candidate back to Kenya.

Speaking to Kenyans.co.ke, Havi stated a case regarding the red alerts had been filed before Justice Edwin Okundi and a ruling would be made on Friday, November 12.

"The only hindrance for Miguna's return was the red alerts. We argued the case before Justice Edwin Okundi. He will deliver the ruling tomorrow at 9am. If the ruling is in favour, there should be no reason as to why any airline should deny him permission to board," Havi stated.

However, if the court will rule against it, the lawyer vowed to appeal the case.

"We have done what is legally required to ensure Miguna comes back," Havi added.

The Canadian-based activist, who announced he had booked a flight to the Jomo Kenyatta International Airport (JKIA), has called on Kenyans of a similar mindset to await him at the airport.

"I have received large volumes of messages requesting permission to welcome me to Kenya. No one needs permission from me, or from anyone else, to go to the JKIA, or anywhere else. 

Miguna added that he had booked his flight using his Kenyan passport.

Mutunga announced that he would travel to Toronto, Canada, to accompany Miguna back home.

"After careful reflection and following broad consultations with lawyers, human rights and justice defenders, progressive politicians, and Mr Miguna himself, I have decided to travel to Toronto, Canada, to accompany Mr Miguna on his flight back to his motherland on 16 November 2021."

"I am also seeking out Kenyan journalists who will accompany me on this historic journey," he stated.
