A grandson of the country's second Head of State the late President Daniel Arap Moi has been kicked out from his residential house over rent arrears and is now on the streets.
Collins Kibet on Monday, February 7 told the High Court in Milimani that he was evicted last week and that he cannot therefore cater for his needs or his family.
The court was told that the rent arrears have accumulated to more than Ksh240,000. This is for the six months period he failed to pay his landlord leading to his eviction.
Collins further revealed that he has been excluded from the management of multi-billion estate that was left by his late father Jonathan Kipkemboi Moi, who passed on in 2019.
The wealth of the late Jonathan is said to be in billions of shillings with the inclusion of what he received from former President Moi’s estate.
Jonathan had however not written a will on the distribution of his vast wealth among his family and dependants, throwing the powerful family into a protracted legal battle.
Collins who is living a troubled life is accusing his stepmother Sylvia Cherotich and stepbrother Clint Kiprono of failing to look after him. He is accusing them of neglecting him despite him being a dependant on the estate left by his late dad, Jonathan.
Despite Sylvia and Clint being the administrators of the estate, Collins argued that he was not involved in the obtaining of court orders to manage the multi billion property.
“The deceased’s first house, where Collins comes from, is not being provided for and is not among the administrators. He was evicted from the house on Friday and is now on the streets. It is saddening considering the nature of the estate,” Collins’ lawyer Duncan Okatch, told Justice Aggrey Muchelule.
In what is slowly escalating into a vicious property row, Collins through his lawyer told the court that he wants to be enjoined as a co-administrator of the estate. He also wants all transactions involving the estate stopped till the case is determined.
“The estate is actively being dealt with although the grant for letters of administration has not been confirmed. Funds are coming in (to the estate) and there is no accountability. He is the eldest son of the deceased,” the lawyer stated.
Collins’ wife Gladys Jeruto and her children are also seeking to be enjoined in the court battle so that their maintenance can be taken care by the estate as the scramble for the billions escalates.
Other than Collin's arguments, Jonathan's widow is also facing separate suits from two women who claim to have been married by the deceased.
