Otiende Amollo's Candidature on the Line After Case Filed

Rarieda Member of Parliament, Otiende Amollo's bid to recapture his seat is hanging in the balance after three voters moved to court to have him barred from the August 9 polls.

In a petition filed at the Milimani Law Courts on Friday, May 27, George Bush, Erick Onyango, and Peter Agoro, asked the court to bar the Independent Electoral and Boundaries Commission from clearing the Senior Counsel over the management of the Constituency Development Funds (CDF).

Amollo was among the few Members of Parliament who received a direct party ticket from the Orange Democratic Movement (ODM) in the party primaries held in April.

The petitioner wants the Legislator compelled to explain the report by the Auditor General which raised questions over some withdrawals from the CDF kitty.

“Amollo is still holding the office even after a very adverse report was delivered against him by the Auditor General dated February 11, 2022, and no action has been taken by the EACC to investigate such very traumatising issues to the people of Rarieda and Kenyans in general,” they petitioned.

Additionally, they indicated that they had written to the Ethics and Anti-Corruption Commission (EACC) demanding that the Legislator be summoned for questioning.

In the February report by Auditor General, Nancy Gathungu, there were inconsistencies in the financial statements on withdrawals made from the CDF kitty.

“A sample of 36 schools picked to confirm whether the cheques were cleared from the bank statements revealed that the cheques in question were not drawn in favour of the schools indicated on the bursary schedule.  

"Instead the cheques totaling Ksh5.8 million were drawn in favour of other payees in different values or denominations,” read the report.

The petition will be mentioned on Tuesday, May 28, ahead of the clearing of candidates by the IEBC.

In 2021, Amollo received an award as the best MP in Kenya after he was recognised for the management of CDF funds.

In particular, his housing project that aims to get rid of grass thatched houses in the constituency was recognised.
