United Democratic Alliance (UDA) Westlands parliamentary candidate, Nelson Havi, has gone after Chief Justice Martha Karambu Koome after she suggested that President Uhuru Kenyatta should be impeached for failing to appoint six Judges proposed by the Judicial Service Commission (JSC).
Havi on Saturday, June 11, stated that the CJ was acting a little bit too late since she appealed a decision compelling the President to swear in the six Judges after he refused to do so despite the recommendations by JSC.
The lawyer stated that CJ Koome agreed with Attorney General, Paul Kihara Kariuki, and the President when they appealed against the decision directing him to swear-in the six Judges.
Havi stated that the CJ's suggestion to impeach Uhuru for violation of the Constitution was a little too late since the damage was already done and she had played ball with the state instead of being impartial on the High Court ruling.
"They got a stay of the decision of the High Court in a ruling delivered by Justices Nambuye, Karanja and Laibuta. CJ Koome, we are not as foolish as you may think," Havi stated.
Havi hinted that CJ Koome was hoodwinking Kenyans since she had refused to side-step the President by swearing-in the six Judges.
The CJ, the AG and the President in their appeal were granted a conservatory order staying the execution of the judgment and orders of the High Court.
On Saturday, the Nation reported that CJ Koome recommended to the Court of Appeal to declare that President Uhuru Kenyatta violated the Constitution by failing to appoint six of the 40 Judges that were nominated by JSC.
CJ Koome wanted the Appellate Court to declare that the answer for the alleged violation is an impeachment of the President from office.
"It is proposed that the court makes a declaration that the President is in violation of Articles 3(1) and 166(1)(b) of the Constitution.
"A declaration that the appropriate remedy for the violation of Articles 3(1) and 166(1)(b) of the Constitution is the impeachment of the President or any other order that secures direct accountability of the President," CJ Koome's court papers read.
President Kenyatta declined to appoint the six Judges recommended by the JSC citing an adverse National Intelligence Service (NIS) brief.
