DPP Makes U-Turn on Dropping Ex-Governor Lenolkulal's Graft Case

Former Samburu governor, Moses Lenolkulal, still has a case to answer in the Ksh80 million graft case.

On Friday, October 14, the Director of Public Prosecution (DPP) Noordin Haji withdrew his initial application where he had asked the court to drop the case against the former county boss.

Haji had told the court that the evidence he had gathered was insufficient in incriminating the governor. 

Magistrate Thomas Nzioka, however, declined his original plea to drop the case and asked the prosecutor to provide sufficient reasons to back their argument.

The case will, therefore, proceed into a full hearing in January 2023, where a determination will be made. 

On October 13, the Law Society of Kenya (LSK) gave the DPP a three-day ultimatum to explain the discontinuation of high-profile graft cases.

LSK President Eric Theuri warned the prosecutor against plunging the country into confusion, questioning whether there was a force behind the new developments.

Theuri noted that with the shortlisting and vetting of nominees to the Cabinet and Principal Secretaries taking place, the country is wired to think that Haji's office had been compromised.

"We are left with a very reasonable presumption that the only intention of withdrawal of these cases is to ensure that those who have been nominated in various positions in the public service to have the hurdles before the eliminated," he stated.

Cabinet Secretary nominee for the Ministry of Public Case Aisha Jumwa's Ksh19 million graft case was also dropped, with the prosecution citing a lack of evidence. 

Her fellow nominee to the Agriculture docket, Mithika Linturi, will also settle a case outside the court after the plaintiff withdrew the lawsuit. 

Jumwa and Linturi will appear before the National Assembly on October 18 and 21, respectively.
